The Rivers State House of Assembly has escalated its ongoing conflict with the state’s executive arm by serving a notice of gross misconduct allegations against Governor Siminalayi Fubara and his deputy, Ngozi Odu. The move, according to the lawmakers, is in compliance with Section 188 of the Nigerian Constitution, which outlines the procedure for removing a governor or deputy governor from office.
In the notice obtained by Channels Television, the Assembly accused the deputy governor of misconduct in the performance of her official duties. The document stated, “In compliance with Section 188 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and other extant laws, we the undersigned members of the Rivers State House of Assembly hereby forward to you a Notice of Gross Misconduct by the Deputy Governor of Rivers State in the performance of the functions of her office.”
The notice marks a significant escalation in the political crisis rocking Rivers State, which has seen tensions between the executive and legislative arms of government reach new heights. The Assembly’s action follows weeks of accusations and counter-accusations, including claims by lawmakers that Governor Fubara has been obstructing the implementation of a Supreme Court judgment and delaying the presentation of the 2025 Appropriation Bill.
The serving of the notice is the first step in a constitutional process that could lead to the impeachment of the deputy governor. Under Section 188 of the Constitution, the Assembly must formally notify the accused officer of the allegations and provide an opportunity for a response. If the allegations are substantiated, the Assembly can proceed with impeachment proceedings.
The development has sparked widespread concern among stakeholders, with many calling for calm and a resolution that prioritizes the interests of Rivers State and its people. The crisis has already disrupted governance in the state, with the Assembly accusing the governor of directing ministries and agencies to cease communication with the legislature.
As the situation unfolds, all eyes will be on the Assembly’s next steps and the response from Governor Fubara and his deputy. The outcome of this constitutional process could have far-reaching implications for the political landscape of Rivers State.
