The Federal High Court in Abuja has thrown away a suit seeking the disqualification of Osun State Governor, Adegboyega Oyetola, as the All progressives Congress (APC) candidate for the election scheduled to hold on July 16.
In his judgement, Justice Inyang Ekwo, declared that the plaintiff, Moshood Adeoti, failed to support the case with relevant laws, and therefore makes his case, which is a gross abuse of court process, invalid.
The judge also mentioned that the suit instituted falls that were outside the scope of section 87(9) of the Electoral Act and Section 22 of the 1999 Constitution as amended.
During the proceedings, Adeoti, a chieftain of the APC who had lost as an aspirant in the governorship primary, prayed the court to void Oyetola’s candidacy on the grounds that the governor had contested in the poll as a member of the party’s Caretaker Extraordinary and Convention Planning Committee (CECPC).
The plaintiff insisted that Oyetola’s action violated the provisions of Section 222 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) and Article 31(iii) of the APC, October 2014 (as amended).
His case was however dismissed by the Judge who ruled in favour of the governor.
Governor Oyetola is aiming at extending his tenure in the seat by another four years, after winning the last election in 2018.
